Terms of Service

1) Acceptance of these Terms

By accessing or using EMITR (the “Service”), you agree to these Terms. If you do not agree, do not use the Service.

2) The Service

EMITR is a browser-based creative tool for building real-time particle animations and exporting them (for example, as video or HTML exports).

3) Accounts and eligibility

• You may sign in using Google or email/password sign-in where available.
• You are responsible for safeguarding your account and for activity under your account.
• EMITR is not intended for children under 13 (or under 16 in the EU).

4) User-generated content (your creations)

• Your particle settings/creations run locally in your browser by default; EMITR does not provide cloud project storage at this time.
• Exports you generate are created locally on your device.
• You are responsible for ensuring you have rights to any content you create or export using EMITR.

5) Pro features, subscriptions, and payments

• Some features require a paid subscription (“Pro”).
• Payments are processed by Stripe. We do not store or have access to your payment card details.
• Subscriptions may renew automatically unless canceled. You can manage billing via the account/billing portal.
• Refunds: Unless required by law, all sales are final and we do not provide refunds.

6) Acceptable use

You agree not to:

• Use EMITR for unlawful, harmful, or abusive purposes.
• Attempt to interfere with or disrupt the Service, including through automated scraping or abuse of authentication/billing systems.
• Reverse engineer the Service except where such restriction is prohibited by law.

7) Intellectual property

• EMITR and the Service (including the software, UI, and design) are owned by LUX LUMN, except for third-party components.
• The name “EMITR” and any logos/marks used with the Service are owned by LUX LUMN.
• You retain rights to your creations and exports you generate using EMITR, subject to any third-party rights in content you incorporate.
• We do not claim ownership of your creations/exports.

Limited license: we grant you a personal, non-exclusive, non-transferable license to use EMITR for your own lawful purposes, subject to these Terms. No other rights are granted.

8) Disclaimer of warranties

EMITR is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9) Limitation of liability

To the fullest extent permitted by law, LUX LUMN will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of EMITR. Where liability cannot be excluded, our total liability for any claim will not exceed the amount you paid to use EMITR in the 12 months preceding the claim.

10) Indemnification

You agree to indemnify and hold harmless LUX LUMN from claims arising out of your use of EMITR, your content, or your violation of these Terms.

11) Termination

We may suspend or terminate your access to EMITR if you violate these Terms or if needed to protect the Service, users, or legal compliance.

12) Governing law

These Terms are governed by the laws of [Your State/Country], without regard to conflict of laws principles. Venue for disputes will be in [Your County/State/Country].

13) Changes to these Terms

We may update these Terms from time to time. We will update the effective date when we do. For material changes, we may notify users by email and/or by a prominent notice in the app.
